1. Who these Terms are with

These Terms of Service (the “Terms”) are a legally binding agreement between you and UseBite (“UseBite”, “we”, “us”, “our”). They govern your use of the UseBite web app at usebite.app and the UseBite Android app available on Google Play (together, the “Service”). By creating a UseBite account, signing in, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

The Service is intended for adults aged 18 or over. By using the Service you represent that you are at least 18 years old and have full legal capacity to enter into these Terms. The Service is not designed for minors and we do not knowingly process the personal data of anyone under 18. If you become aware that a minor has registered, please contact us at support@usebite.app and we will delete the account.

3. Licence to use UseBite

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the Service for your personal, non-commercial use. The Service, including all software, designs, text, images, logos, and other content (other than user content you submit) is owned by us or licensed to us, and is protected by copyright, trade-mark, and other intellectual-property laws.

4. Your account

To use the Service you must sign in with a valid Google account. You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity carried out under your account. Notify us immediately at support@usebite.app of any unauthorised use of your account.

You may delete your account at any time, which will remove your data from our systems within 30 days, save where retention is required by applicable law (see Privacy Policy § 13).

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful, harmful, fraudulent, or abusive purpose.
  • Submit content that is unlawful, infringing, defamatory, obscene, or that includes malware.
  • Attempt to reverse engineer, decompile, disassemble, scrape, or otherwise extract the source code, models, or back-end behaviour of the Service, except to the extent expressly permitted by mandatory applicable law.
  • Interfere with, disrupt, or place an unreasonable burden on the Service, our infrastructure, or the third-party services we depend on (including the AI-API providers).
  • Resell, redistribute, sublicense, or otherwise commercially exploit the Service or any data accessed through it.
  • Use the Service to develop a competing product, including by using AI outputs as training data for a competing model.
  • Bypass, circumvent, or disable any rate limit, credit check, or security control built into the Service.
  • Submit photos that depict people who have not consented to being photographed, where such consent is required by law.

We may suspend or terminate accounts that violate these rules, immediately and without notice where the violation is serious.

6. Your content

Your Content” means the data you submit to the Service: meal descriptions and photos, activity descriptions, weight readings, profile information, location, feedback, and similar. You retain ownership of Your Content. By submitting Your Content you grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit to third-party AI processors as necessary to operate the Service, and display Your Content back to you within the Service, for the lifetime of your account plus the retention periods set out in our Privacy Policy.

You represent and warrant that (a) you own or have the necessary rights to Your Content, and (b) Your Content does not infringe any third-party rights, breach any duty of confidentiality, or violate any applicable law.

6A. Feedback and Suggestions

If you submit feedback, suggestions, ideas, comments, recommendations, bug reports, or other input regarding the Service (“Feedback”) — whether through the in-app feedback form, by email to support@usebite.app, or by any other means:

  • You acknowledge that all Feedback is non-confidential and non-proprietary, even if marked otherwise.
  • You assign to us all right, title, and interest in and to the Feedback (including all intellectual-property rights) on a worldwide, perpetual, irrevocable, royalty-free basis. To the extent any rights cannot be assigned, you grant us a worldwide, perpetual, irrevocable, royalty-free, fully paid-up, sublicensable, transferable licence to use, reproduce, modify, prepare derivative works of, distribute, display, and otherwise exploit the Feedback for any purpose, with no obligation to you.
  • You waive, to the maximum extent permitted by law, any moral rights, attribution rights, or rights of integrity you may have in the Feedback.
  • We are under no obligation to use, attribute, compensate you for, acknowledge, or respond to any Feedback. The fact that the Service later includes a feature similar to your Feedback does not imply your Feedback was the source.
  • This clause survives termination of these Terms.

Standard SaaS feedback license. It exists so the Service can evolve based on user input without ambiguity over feature ownership.

7. Health, AI accuracy, and no medical advice

UseBite is a personal nutrition-tracking tool. It is not a medical device, not a clinical service, and not a substitute for professional advice. All calorie estimates, macro breakdowns, weight projections, energy-model calculations, and meal recommendations are AI-generated approximations. They may be materially inaccurate and you should not rely on them as the basis for a clinical, medical, dietetic, or other significant decision. Always consult a qualified professional before making significant changes to your diet.

AI cannot reliably detect allergens. Never use UseBite to identify food allergens or assess allergy-related risks.

UseBite is not suitable for, and should not be used by: anyone under 18; anyone with a current or past eating disorder; anyone who is pregnant or breastfeeding; anyone with diabetes or another condition that affects metabolism; or anyone recovering from disordered eating. If any of these apply to you, please use a clinically supervised tool and seek professional advice.

8. Credits, ads, and payments

Most use of the Service is free. AI-powered features consume in-app credits. New accounts receive a starting credit balance. On the Android app, you can earn additional credits at no monetary cost by watching an optional rewarded video advertisement (see Privacy Policy § 11). You may also be offered the option to purchase a credit pack for a one-time fee, which removes the need to watch ads to keep using AI features.

Credits are a non-monetary in-app currency. They have no cash value, are not transferable, and are not refundable for cash, save where required by applicable consumer-protection law. We may modify the credit cost of any feature, or the size or price of credit packs, at our discretion; material changes will be notified before they take effect.

Credit-pack purchases on Android are currently processed by Google Play Billing; you will receive an itemised receipt directly from Google. We may offer web-based purchases via Stripe Inc. or another processor in the future, in which case those terms will be disclosed at point of purchase. Refund requests will be considered in accordance with mandatory consumer-protection law in your country of residence; outside any mandatory right, credit-pack purchases are non-refundable once the credits have been added to your balance, save where the credits have not yet been used and you request a refund within 14 days of purchase.

Credit validity and service changes. Credits do not expire under normal operation of the Service. However, we reserve the right to (a) expire credits on accounts that have shown no activity (no sign-in or sync with our servers) for 12 consecutive months, after providing at least 30 days’ advance notice through the contact channels associated with the account; (b) modify or discontinue the credit system, in part or in full, with at least 30 days’ notice provided in-app and where possible by email; and (c) wind down or discontinue the Service in its entirety, with at least 30 days’ notice, after which remaining credits are forfeited without further obligation, save where refund is required by applicable consumer-protection law in your jurisdiction. We will use commercial best efforts to notify users before exercising any of the above. Credits are not redeemable for cash and do not represent a debt obligation against us; their utility is limited to use within the Service while it remains available.

9. Service changes, suspension, and termination

We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We will give reasonable advance notice of any change that materially reduces your rights or the functionality you rely on, except where the change is required by law or to address a security risk. We may suspend or terminate your account immediately, without notice, if you breach these Terms or where we are required to do so by law. On termination, your licence under these Terms ends and your data will be deleted in accordance with our Privacy Policy.

10. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted operation. We do not warrant that the Service will be error-free, secure, available at all times, or that AI outputs will be accurate or complete. You use the Service at your own risk and discretion.

This clause does not exclude or limit any liability that cannot lawfully be excluded or limited under the consumer-protection laws of your country.

11. Limitation of liability

To the maximum extent permitted by law:

  • We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profit, revenue, data, goodwill, or anticipated savings, arising out of or in connection with your use of, or inability to use, the Service.
  • Our total aggregate liability arising out of or in connection with the Service or these Terms — in contract, tort (including negligence), under statute, or otherwise — is limited to the maximum extent permitted by applicable law in your jurisdiction.
  • We will not be liable for any health outcome — including weight gain or loss, nutritional deficiency, allergic reaction, eating-disordered behaviour, or any other physical or psychological consequence — arising from or attributed to use of the Service. The Service is informational only.

Nothing in these Terms excludes or limits our liability for fraud, fraudulent misrepresentation, death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded or limited under applicable law.

12. Indemnity

You agree to defend, indemnify, and hold harmless us and our agents from and against any third-party claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of (a) Your Content; (b) your breach of these Terms; or (c) your violation of any applicable law or third-party right.

13. Third-party services

The Service depends on third-party processors listed in our Privacy Policy § 5. Each such processor operates under its own terms and privacy policy. We are not responsible for the acts or omissions of those third parties, including but not limited to AI-output content, ad-content, payment-processing failures, or service interruptions on their side. To the extent any third-party processor's terms apply to your use of the Service, those terms govern the relevant interaction.

14. Governing law and jurisdiction

These Terms, and any dispute arising out of or in connection with them or the Service, are governed by the laws of Singapore, without regard to its conflict-of-laws principles. The courts of Singapore have exclusive jurisdiction over any such dispute, save that, where you are a consumer resident in a jurisdiction whose mandatory consumer-protection law grants you a non-waivable right to bring proceedings in your country of residence and/or to enforce mandatory consumer-protection rights of your country of residence regardless of the choice of law above, that right is preserved notwithstanding this clause. This expressly includes (without limitation) consumers in the European Union, the United Kingdom, the United States (and applicable state-level laws), Canada, and Australia.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the app or by email at least 14 days before they take effect; non-material changes will be reflected on this page with an updated date and version. Your continued use of the Service after the effective date of any change constitutes your acceptance of the revised Terms. If you do not accept a material change, your remedy is to delete your account before the change takes effect.

16. Miscellaneous

  • Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreement.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
  • No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
  • Assignment. You may not assign or transfer these Terms; we may assign them to a successor in interest.
  • Notices. Notices to us must be sent to support@usebite.app. Notices to you may be sent to your sign-in email or via in-app message.
  • Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, war, civil unrest, government action, internet outage, or third-party service failure.
